Notes:-
There is now legislation to ensure the owners of Leylandi Conifers maintain the trees at an acceptable height to protect the rights of adjacent properties.

The roots of a Leylandi Conifer can spread a considerable distance and this can cause several problems for neighbouring properties because they withdraw moisture from the soil, causing it to dry out.

In addition to soil damage, conifer roots also cause problems to foundations and pathways and it is recommended to plant a tree at least 35 meters away from a property. Large trees also casue an issue when insuring your property. Although conifer roots are shallow, they spread up to seven times as wide as they mature and it is important not to plant within root distance of drains, pathways or the foundations of a property.

Over 5 years ago OFC Land Ltd invited residents by letter to consent to a maintenance program and sign a simple maintenance agreement, and there has been no response, therefore the company is now working towards the lowest level of maintenance for the future.

The reason the company require's residents to agree to a maintenance agreement is simple and it is because there are only two homeowner's in the OFC courtyard who are contracted within their title deeds to comply with the positive covenants of the transfer document and this leaves OFC Land Ltd (The land owner) exposed and potentially unable to collect maintenance charges.
